FDA Compliance & Food Safety Standards

Every product we supply meets or exceeds U.S. Food & Drug Administration regulations for food-contact materials. Learn about our certifications, testing procedures, and quality assurance commitments.

Every Cup, Every Bowl — Fully Compliant

At Cup Source, food safety isn't an afterthought — it's the foundation of everything we do. All of our products are manufactured in facilities that comply with 21 CFR Part 177 (Food-Contact Polymers) and 21 CFR Part 176 (Direct Food-Additive Adhesives and Coatings).

We conduct rigorous third-party testing on every production batch to verify compliance with FDA limits for migration, heavy metals, and chemical residues. Our quality management system is audited annually by independent registrars.

Whether you're serving hot coffee, cold smoothies, or hot soup — your customers' safety is guaranteed with every Cup Source product.

Key FDA Regulations We Follow

Our products are designed and manufactured to comply with the following FDA regulatory frameworks for food-contact materials.

📋

21 CFR Part 177 — Indirect Food Additives

Covers polymers used in food-contact articles, including paper, paperboard, polyethylene, polypropylene, polystyrene, and laminated coatings. All Cup Source cups and containers fall under this regulation.

🔬

21 CFR Part 176 — Adhesives & Coatings

Regulates adhesives and coating components used in food packaging. Our PE and PLA liner coatings, as well as water-based printing inks, meet all specified migration limits.

Our Testing & Verification Process

Every product batch undergoes a multi-step testing protocol before it leaves our facility.

1

Raw Material Inspection

All incoming raw materials are inspected and tested for purity, composition, and compliance with FDA specifications. Certificates of Analysis (CoA) are required from every supplier.

2

Migration Testing

Simulated food-contact migration tests are performed per FDA 21 CFR 177.1610 methods. Total migration and specific substance migration (e.g., heavy metals, BPA, phthalates) are measured.

3

Thermal & Structural Testing

Products are tested for heat resistance, water permeability, and structural integrity under real-world conditions — including hot-fill, microwavability, and freeze-thaw cycles where applicable.

4

Microbiological Testing

Surface microbial testing ensures products meet FDA sanitation standards. This includes testing for total aerobic microbial count, E. coli, Salmonella, and Staphylococcus aureus.

5

Third-Party Lab Verification

Independent laboratories (SGS, Intertek, or equivalent) conduct annual verification testing. Results are documented and available for customer review upon request.

6

Batch Release & Documentation

Each production batch receives a Batch Release Certificate with full traceability, including raw material lot numbers, test results, and QA sign-off before shipment.

Frequently Asked Questions

Common questions about our FDA compliance, certifications, and food safety practices.

Yes. Every product in our catalog is manufactured in accordance with applicable FDA regulations, specifically 21 CFR Parts 174–178 for food-contact substances. While the FDA does not "approve" individual food packaging products (they regulate the materials and their intended use), all Cup Source products use FDA-compliant materials and processes. We provide Certificates of Compliance (COC) with every order.
Absolutely. None of our products contain BPA, BPS, or other bisphenols. Our polycarbonate-free approach extends to all plastics, linings, and coatings. Migration testing confirms that all products are free from detectable levels of bisphenols.
Yes, we provide a Certificate of Compliance with every shipment. Upon request, we can also provide third-party lab test reports (from SGS or Intertek), material safety data sheets (MSDS), and FDA compliance declarations. Contact your account manager or email compliance@cupsource.com.
Our compostable products are certified by the BioPreferred Institute (BPI) and meet ASTM D6400 standards for industrial compostability. They break down in commercial composting facilities within 180 days. Please note that home composting may require longer decomposition times and specific conditions.
Yes. In addition to FDA compliance, our products also meet EU Regulation (EC) No 1935/2004 for materials intended to come into contact with food, as well as EU Framework Regulation requirements. We provide EU compliance declarations for international orders upon request.
We perform batch-level testing on every production run for critical safety parameters (migration, microbial count). Full comprehensive testing — including heavy metal analysis, BPA screening, and full migration profiling — is conducted quarterly and after any raw material or process change.
