Welcome to Terroir Cocoa. By accessing our website, purchasing our products, or utilizing any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or purchase our products.
These Terms constitute a legally binding agreement between you and Terroir Cocoa ("Company," "we," "us," or "our"). We reserve the right to modify these Terms at any time, and your continued use of our services following any changes constitutes acceptance of the updated Terms.
2. Products & Orders
Our website features a selection of artisan chocolate products grown and crafted at our family farm. All product descriptions, imagery, and specifications are provided in good faith and are believed to be accurate. However, due to the natural variability of agricultural products and handcrafted goods, slight variations in appearance, flavor profile, or weight may occur.
By placing an order, you represent that you are at least 18 years of age or have parental consent, and that you have the legal capacity to enter into a binding contract. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, or suspected fraudulent activity.
3. Pricing & Payments
All prices are listed in USD unless otherwise specified and are subject to change without notice. Taxes, duties, and additional fees are not included in the displayed prices and will be calculated at checkout where applicable.
Payment must be made in full at the time of purchase. We accept major credit cards and selected secure payment processors. By providing your payment information, you authorize us and our payment partners to charge your payment method for the total order amount, including any applicable taxes and shipping fees.
2. Shipping & Delivery
We ship directly from our farm and distribution facilities worldwide. Delivery times vary based on your location, carrier availability, and customs processing for international orders. Estimated delivery windows are provided at checkout but are not guaranteed.
Chocolate is a temperature-sensitive product. While we package all orders with protective insulation and cooling elements where necessary, we are not liable for melting or texture changes resulting from extreme weather conditions, carrier delays, or failure to refrigerate upon receipt.
5. Returns & Refunds
We want you to love your Terroir Cocoa chocolate. If you are not completely satisfied, you may request a return or refund within 14 days of delivery, provided the product is unopened and in its original packaging.
Due to health and safety regulations, we cannot accept returns on opened, partially consumed, or temperature-compromised chocolate. Refunds will be issued to the original payment method within 5–10 business days of approval. Shipping costs for returns are the responsibility of the customer unless the return is due to our error or a defective product.
6. Intellectual Property
All content on this website, including but not limited to text, graphics, logos, images, photographs, videos, audio clips, software, and the overall design and layout, is the exclusive property of Terroir Cocoa or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from this website without our express written permission. The Terroir Cocoa name, logo, and related marks are trademarks and may not be used without authorization.
7. User Conduct
When using our website or interacting with our brand, you agree to:

These Terms shall be governed by and construed in accordance with the laws of Ecuador, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or your use of our website shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Quito, Ecuador.
You agree to waive any right to participate in class-action lawsuits or consolidated proceedings against us. This provision does not limit your right to pursue individual claims in small claims court.

We may update these Terms from time to time to reflect changes in our business, legal requirements, or operational practices.
