1. Acceptance of Terms

By accessing, browsing, or purchasing products from Terroir Cocoa ("we," "our," or "us"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with any portion of these Terms, you must immediately discontinue use of our website and services.

These Terms constitute a legally binding agreement between you and Terroir Cocoa. We reserve the right to update these Terms at any time. Your continued use following any modifications constitutes acceptance of the revised Terms.

2. Products & Quality Standards

Terroir Cocoa specializes in single-origin, farm-to-bar artisanal chocolate. All products are cultivated, fermented, and crafted on our family estate using sustainable agricultural practices.

Natural Variation Notice: As our chocolate is derived from hand-harvested cacao beans grown in varying microclimates, slight variations in color, flavor profile, and bean appearance between batches are natural and expected. These variations do not indicate defects.

We strive to accurately represent product weight, cocoa percentage, origin, and flavor notes. However, we do not guarantee that website colors or imagery will exactly match the physical product due to screen calibration and natural agricultural factors.

3. Orders & Payments

  • Order Acceptance: All orders are subject to availability and verification. We reserve the right to refuse or cancel any order for any reason, including pricing errors or suspected fraud.
  • Pricing: All prices are listed in USD and include applicable base shipping rates. Taxes are calculated based on your shipping destination.
  • Payment Processing: Payments are securely processed by our third-party payment gateway. We do not store full credit card details on our servers. All transactions are encrypted via SSL.
  • Age Restriction: You must be at least 18 years of age (or the age of majority in your jurisdiction) to place an order on our site.

4. Shipping & Delivery

Our chocolate is carefully packaged in temperature-controlled materials to preserve freshness. Due to the perishable nature of artisanal chocolate:

  • We ship Monday through Thursday to avoid weekend warehouse delays during warm months.
  • Delivery times are estimates and not guaranteed. Terroir Cocoa is not liable for delays caused by carriers, customs, or extreme weather conditions.
  • For international orders, import duties, taxes, and customs fees are the sole responsibility of the recipient.
  • If your order arrives damaged or compromised due to improper handling, please contact us within 48 hours with photographic evidence for resolution.

5. Returns & Refunds

To maintain strict food safety standards, we only accept returns for unopened, undamaged products within 7 days of delivery. Due to the perishable nature of our chocolate, items must be stored at room temperature prior to return and cannot be refrigerated or frozen.

Refunds will be issued to the original payment method within 5–7 business days after we receive and inspect the returned items. Return shipping costs are the responsibility of the customer unless the product was defective or incorrectly shipped by us.

6. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, cacao cultivation methodologies, chocolate recipes, fermentation techniques, and brand names, is the exclusive property of Terroir Cocoa or its licensors and is protected by international copyright, trademark, and trade secret laws.

You may not reproduce, distribute, modify, or create derivative works from any website content without our express written consent. Unauthorized use may result in termination of access and legal action.

7. User Conduct & Prohibited Activities

When using our website or services, you agree not to:

  • Use automated systems, scrapers, or bots to access, collect, or extract data from our site.
  • Attempt to gain unauthorized access to our servers, user accounts, or networks.
  • Post or transmit any material that is defamatory, obscene, fraudulent, or infringes upon third-party rights.
  • Resell our wholesale products through unauthorized retail channels without a valid partnership agreement.

8. Disclaimers & Limitation of Liability

Food Allergy Warning: Our chocolate is crafted in a facility that processes tree nuts, dairy, soy, and gluten. While we maintain strict segregation protocols, we cannot guarantee complete absence of cross-contamination. Consumers with allergies should review ingredient labels carefully.

The information provided on this website is for general purposes only and does not constitute dietary, medical, or nutritional advice. Terroir Cocoa shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our website, products, or reliance on information provided herein.

Our total liability to you for any claim arising out of or related to these Terms or our products shall not exceed the purchase price of the specific product giving rise to the claim.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, USA, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of our services shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be settled through binding arbitration in King County, Washington, in accordance with AAA commercial rules.

We may revise these Terms at any time to reflect changes in our practices, legal requirements, or service offerings. Material changes will be communicated via email to registered users and posted on this page with an updated "Effective Date." Your continued use of our website or services after such changes constitutes acceptance of the revised Terms.
